1. Introduction

Welcome to MAL Group (“we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your use of our online store at www.maldistributors.co.za, as well as all purchases, interactions, and services offered through it. By accessing our website, social media pages, or by purchasing from us online or in store, you agree to be bound by these Terms.

Please read them carefully before using our site or completing any transactions. If you do not agree with any part of these Terms, you should not use our website or services.

These Terms apply to all visitors, users, and customers of our online store and physical store. Additional terms may apply to specific promotions, warranties, or subscription services, which will be communicated at the time of participation or purchase.

3. Eligibility

3.1. You must be at least 18 years old to make purchases through our website.
3.2. If you are under 18 years of age, a parent or legal guardian must consent to and supervise your use of the site and any purchase made.
3.3. By using this website, you confirm that you have the legal capacity to enter into binding agreements.

4. Product Information and Availability

4.1. We make every effort to ensure that product details, descriptions, images, and pricing are accurate. However, mistakes can occur, and we reserve the right to correct any errors or omissions without prior notice.
4.2. Product specifications, features, and availability may vary or change without warning.
4.3. All products are subject to stock availability. If an item you ordered is unavailable, we will notify you and provide an alternative or full refund.
4.4. Images are for illustration purposes and may differ slightly from the actual product.

5. Pricing, Payment, and VAT

5.1. All prices are listed in South African Rand (ZAR) and include VAT unless otherwise specified.
5.2. Full payment is required before dispatch or collection of any goods, unless otherwise agreed in writing.
5.3. Accepted payment methods include EFT, PayFast, and (where applicable) in-person payments via cash or card at our Port Elizabeth warehouse.
5.4. PayFast transactions incur a processing fee, which will be reflected at checkout.
5.5. You confirm that you are authorised to use the chosen payment method.
5.6. We reserve the right to refuse or cancel any order if payment is not received or if fraudulent activity is suspected.

6. Order Confirmation and Acceptance

6.1. Acceptance and completion of the sale occur only once payment has cleared and the goods have been dispatched.
6.2. We reserve the right to cancel or decline any order due to stock unavailability, pricing errors, administrative errors, or suspected fraud.
6.3. In the event of a cancellation, any payment received will be refunded in full should unless admin or courier charges have already be partial or fully actioned..


7. Shipping and Delivery

7.1. We deliver throughout South Africa using reputable courier partners.
7.2. Delivery timeframes vary depending on product availability, location, and courier schedules. Estimated delivery times provided on our website are for guidance only and not guaranteed.
7.3. Once your order is dispatched, tracking details (where applicable) will be provided.
7.4. Ownership (title) of goods passes to you once full payment has been received.
7.5. Risk of loss or damage passes to you once delivery is confirmed at your chosen address.
7.6. It is your responsibility to ensure that delivery details provided are accurate and accessible. Any failed deliveries due to incorrect information may incur additional fees.

8. Returns, Refunds, and Exchanges

We comply with the Consumer Protection Act (CPA) and strive to make your shopping experience fair and transparent.

8.1. You may return most items within 7 days of receiving them, provided that:
The item is unused, in its original packaging, and in new resalable condition. An engraved battery is considered as used.
Proof of purchase is provided.
8.2. Certain items, including electrical components, consumables, or special-order products, are not eligible for return unless defective.
8.3. For faulty, damaged, or incorrect items, please contact us at
Lindsay@mal.solar within 48 hours of delivery. Include your order number, photos of the product where possible and a description of the fault.
8.4. Once your return is approved, you may choose between a replacement, store credit, or refund (processed via the original payment method).
8.5. Refunds are processed once the returned goods have been received and inspected. Allow up to 10 working days for funds to reflect.
8.6. Return shipping costs are the customer’s responsibility unless the return is due to our error or a defective item.

9. Warranties and Liability

9.1. Products may carry manufacturer warranties, which vary by brand and product type. Warranty claims are subject to the manufacturer’s policies and procedures.
9.2. MAL Group shall not be held liable for indirect, consequential, or incidental losses arising from the use or inability to use our products or website.
9.3. Our total liability to you will not exceed the total value of the item purchased.
9.4. The warranty does not cover damage resulting from misuse, incorrect installation, or unauthorised modification.
9.5 All warranties with the MAL Group are Carry-In 

10. Privacy and Data Protection

10.1. We respect your privacy and handle your personal information in compliance with the Protection of Personal Information Act (POPIA).
10.2. By using our website, you consent to the collection and processing of your personal data for order fulfilment, communication, and marketing (where consent is provided).
10.3. We do not sell or share your information with third parties except when required by law or necessary to complete your transaction.

11. Intellectual Property

11.1. All website content — including images, product descriptions, text, and branding — is owned by or licensed to MAL Group.
11.2. You may not reproduce, copy, distribute, or modify any part of the website without prior written consent.
11.3. Any unauthorised use of our intellectual property may result in legal action.


12. Bundle Deals/Combo Deals

12.1. We may from time to time offer bundle deals for sale under the Combo Deals tab on the Website (“ComboDeals“). Each Bundle Deal will consist of two or more products that either we or you (as provided on the Website) have combined together in a single bundle.
12.2. Any saving or discount resulting from purchasing a Bundle Deal instead of its component products separately may be applied to any of the component products individually in our sole discretion. The actual purchase price (after applying any applicable saving or discount) of each component product will be communicated to you upon checkout and reflected in your order history. This is relevant to the amount that would be refunded to you, if you were to return any product in a Bundle Deal for a refund, in accordance with our Returns Policy.

13. Linking to third party websites

13.1. This Website may contain links or references to other websites (“Third Party Websites”) which are outside of our control, including those of advertisers. These Terms and Conditions do not apply to those Third Party Websites and Takealot is not responsible for the practices and/or privacy policies of those Third Party Websites or the “cookies” that those sites may use.
13.2. Notwithstanding the fact that the Website may refer to or provide links to Third Party Websites, your use of such Third Party Websites is entirely at your own risk and we are not responsible for any loss, expense, claim or damage, whether direct, indirect or consequential, arising from your use of such Third Party Websites or your reliance on any information contained thereon.

14. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa.
Any dispute arising from or related to these Terms shall fall under the exclusive jurisdiction of South African courts.


15. Full Sales Terms and Conditions


15.1 Application of Terms
All sales, quotations, deliveries and supplies made by MAL Battery Distributors are subject to these sales terms and conditions. No terms or conditions stipulated by the customer shall be binding unless expressly accepted in writing by MAL Battery Distributors.
15.2 Quotations
All quotations are valid for a period of 7 days from date of issue, unless otherwise stated in writing, and are subject to stock availability. Prices quoted exclude delivery charges unless expressly stated. MAL Battery Distributors reserves the right to correct any bona fide errors on quotations or invoices.
15.3 Pricing and VAT
All prices are quoted in South African Rand and are exclusive of VAT unless otherwise stated. VAT will be charged at the prevailing statutory rate. Prices are subject to change without notice.
15.4 Payment Terms
All accounts are payable strictly in accordance with the payment terms agreed in writing. MAL Battery Distributors reserves the right to require payment in advance, suspend deliveries, or cancel orders should payment terms not be adhered to.
15.5 Overdue Accounts and Interest
Interest will be charged on any and all overdue amounts at the ruling overdraft rate plus 2%, calculated monthly in arrears from the due date until date of final payment. The customer shall be liable for all costs incurred by MAL Battery Distributors in recovering overdue amounts, including legal fees on an attorney and client scale.
15.6 Ownership and Risk
Ownership of all goods supplied shall remain vested in MAL Battery Distributors until payment has been received in full and cleared in the company’s bank account. In the event of non-payment, late payment, or if the customer’s card or banking method is cancelled, reversed or dishonoured for any reason, MAL Battery Distributors shall be entitled to immediately reclaim possession and ownership of all goods supplied, without prejudice to any other rights. The customer shall be liable for all bank charges, penalties and fees associated with any dishonoured or reversed banking transactions. Risk in the goods shall pass to the customer upon delivery.
15.7 Delivery
Delivery dates are estimates only and not guarantees. MAL Battery Distributors shall not be liable for any loss or damages arising from late or non-delivery. Delivery shall be deemed to have taken place upon signature of delivery documentation or handover to a carrier.
15.8 Shortages and Delivery Discrepancies
The customer must notify MAL Battery Distributors in writing of any shortages, damages or discrepancies between quantities shipped and quantities received within 24 hours of receipt of goods. Failing such written notification within the specified time period, no claims will be recognised or accepted.
15.9 Goods Bought Out
Goods bought out or procured specifically on behalf of a customer will not be considered for credit/refund
 or return under any circumstances.
15.10 Returns and Credits
Returned goods will not be accepted unless prior written authorisation has been obtained from MAL Battery Distributors within seven days of the original purchase date. All approved returns for credit will be subject to a 20% rehandling fee. Goods returned must be in original, unused and saleable condition with all packaging intact. Goods returned without authorisation, outside the stipulated time period, or not in resale condition will not be accepted.
15.11 Special Order Items
Any product classified as a special order item is non-returnable and non-refundable under any circumstances.
15.12 Warranties
Goods are supplied subject only to the manufacturer’s warranties, if any. MAL Battery Distributors makes no additional warranties, whether express or implied, including any implied warranties of merchantability or fitness for purpose, except as required by law.
15.13 Limitation of Liability
MAL Battery Distributors shall not be liable for any indirect, consequential or economic loss, including loss of profits, arising from the supply or use of the goods. Liability, where not excluded by law, shall be limited to the replacement or repair of the goods or the value thereof, at MAL Battery Distributors’ discretion.
15.14 Force Majeure
MAL Battery Distributors shall not be liable for failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, strikes, load shedding, transport disruptions, supplier failures, fire, flood or government action.
15.15 Cancellation
Orders may not be cancelled without prior written consent from MAL Battery Distributors. Cancellation, if approved, may be subject to a cancellation fee to recover costs incurred.
15.16 Compliance with Laws
The customer shall ensure that all goods are used, installed and disposed of in compliance with all applicable laws, regulations and safety standards.
15.17 Consumer Protection Act
Where the Consumer Protection Act, 68 of 2008 applies, nothing in these terms shall be interpreted as limiting or excluding any rights afforded to consumers under the Act.
15.18 Governing Law and Jurisdiction
These terms and conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. The parties consent to the jurisdiction of the Magistrate’s Court notwithstanding that the amount in dispute may exceed its monetary jurisdiction.
15. 19 Severability
If any provision of these terms and conditions is found to be invalid or unenforceable, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
15.20 Entire Agreement
These terms and conditions constitute the entire agreement between the parties relating to the sale of goods and supersede all prior agreements or understandings, whether written or oral.

16. Amendments to These Terms

We may update or modify these Terms from time to time without prior notice.
The latest version will always be available on our website and takes effect immediately upon posting.
By continuing to use our site after updates, you agree to be bound by the revised Terms.
